Homeowner Email Alert (9/8/2008):

Dear Somerset Brooke Homeowners:  (Email sent to homeowners on 9/8/2008 - Please email board@sbrooke.com to add your email to our distribution list!)

I wanted to pass information to you which came from a neighbor in the Afton Hills subdivision.    There is a proposal underway to place a 120 foot cellular tower at 145th and Antioch within the KCPL Substation.  This weekend, residents in that area put up a balloon to indicate the approximate location and height of that structure.   I was not aware of the link between the cell tower and balloons, but I did notice them on Sunday and thought they looked very high and were quite noticeable from a distance.

The next Planning Commission meeting is scheduled for Sep 22nd  if you would like to comment on the proposal - I wrote an email this morning to the city contacts below to express my own concerns.

Thank you,

Doug

Subject: Cell tower proposal at 145th & Antioch

Dear Neighbor,

I would like to inform you of a significant change regarding the proposed cell tower at 145th and Antioch.  We were initially informed by Selective Site Consultants (SSC) that an existing 120 foot pole in the KCPL substation would be replaced by a 120 foot cell tower.  Therefore, no change in pole height would be noticed.  In reality, the existing pole is only 74 feet in height.  Therefore, the proposed cell tower will extend an additional 46 feet above the existing pole.  This will result in a significant change in pole height and overall appearance.

I have concerns that even the 120 foot proposed tower may not satisfy T-Mobile and/or coexisting carriers.  There are no guarantees that at some point in the future, further applications are not filed proposing an amendment to the existing structure - enabling the cellular companies to again build an even taller more obtrusive tower.

In an effort to better visualize just how tall a 120 foot tower is, look for the balloons tethered to a rope near the vicinity of 145th & Antioch.  The balloons will represent the actual height of the proposed tower, and give each of us a better picture of what may soon become the obstruction we focus on each time we leave our home or look out our window.

Due to the geographic location of the tower site, it is mathematically impossible for us as a community to file a "valid" protest petition.  Therefore, the code requires only a simple majority of the City Council  to approve this application for the cell tower installation.

Presently, we still have the time and opportunity to discourage this proposal.  I urge you to contact your city council members NOW.  I have listed below all council members names as well as their contact information.  Remember, only seven of the twelve members must be in favor of the project in order for it to be approved.  Contact EACH  of  them.

If the cell tower is approved by the city and installed, it will be virtually impossible to ever remove it.

This proposal will be discussed at the next Planning Commission meeting scheduled for Monday, September 22nd at 1:30pm at City Hall.  The final decision will be determined by the City Council, date has yet to be determined. Please call me if you have any other thoughts or ideas on how we can effectively block this measure.

Sincerely,

Sally Lahasky

SAFETY FIRST!!!

The weather this summer is so much warmer and sunnier than last year!   Many of our SB families are taking full advantage of the pool – which is great! But we need to keep safety at the pool as our first priority.  Recently it was brought to our attention that a small child, about the age of a kindergartener, was seen inside the pool fence alone.  No parent, no older sibling, no other residents, just the child.  Please, please, please know where your children are.  Don’t assume that someone else is watching them or that they are being watched by other children.  It only takes a minute, a split second, for a young child to quickly get out of our sights.  With the recent pool tragedies in the KC Metro area let’s not even consider letting anything close to that happen here.  And on the same note, when you leave or enter the pool, make sure that the gate shuts tightly behind you.  Give it a little shake or check the handle.  That way we are not leaving it open for anyone of any age to easily enter without a key. Remember, children under the age of 12 are not allowed to be at the pool without an adult.  If you have any concerns about misuse of the pool or privileges, contact a member of the board.  SAFETY FIRST!!!

bullet Guys Night Out
There was a great turn out for the first neighborhood Guys Night Out. The guys hung out on the back deck of the Hardy home and were entertained by Guy Snowdy stories. Some even stayed for late night poker. It was a great time by all who attended. For a few of the guys, the fun even spilled into the next day with some Sunday golf. If you are interested in the next guys night out, please get your e-mail address to GNO Chair, Hix Hardy (HIXERSMIX@AOL.COM) so that you can be added to the list.

bullet Leash Laws
It has come to the attention of the board that there are several dogs that are running loose in our neighborhood, going through trash and wasting in yards. Not only is this inconsiderate to your neighbors, but it is also against the law. Please be courteous to your neighbors keep your dogs on your own property, or on a leash. Below is the ordinance set forth by the City of Overland Park relating to this issue:

City of Overland Park - www.opkansas.org

Leash Laws
Pet owners may find it tempting to take Rover for a walk without a leash. However, you are reminded to keep your dog on a leash and under control.
Overland Park has a leash law. Dogs must be on a leash at all times when not confined to your own personal residence.
The leash may not exceed 10 feet in length and must be held by an individual. Letting a dog run loose with a leash attached but not held by an individual is a violation of the city’s leash law ordinance.
Violation of the ordinance may result in a fine of $70 or more.
Johnson County’s Stoll Park, Heritage Park and Shawnee Mission Park all have off-leash areas. For more information, call 913/438-7275.
Leash regulations
All dogs by law are to be under the control of their owner or keeper. Dogs are under control when:
• Confined to the residential property of the owner.
• On a leash no longer than ten feet, controlled by a responsible person.
• In a cage or enclosed interior of a vehicle. It is illegal to transport an unrestrained animal in an open truck bed.
If you wish to report a loose animal, call Animal Control at 913/895-6300.

bulletTemporary Basketball Goals:

Please remember that the current by-laws restrict the use of temporary basketball goals on the front of our properties.  We really appreciate those who have complied with this request and have either removed them, or made them permanent.  However, we still have some neighbors who still have them up - We are asking that each homeowner take individual responsibility so the Home Owner Association does not have to take further steps to enforce the by-laws.  Cooperation is the best way to show respect for our community and maintain good relationships with your neighbors.
